Common Law

Common Law originated in Medieval England and made its way to the New World. In 1215, when a group of barons revolted against heavy taxes levied by King John, the result was Magna Carta, a document of rights, protections, and limitations on the crown.

In Common Law countries, judges rely on precedents set by previous courts. Certain courts, such as the Supreme Court of the United States, have the ability to strike down laws that were passed by legislators if those laws violate the Law of the Land (i.e., the Constitution)

The United States Constitution was written in 1787, ratified in 1788, and has been the Law of the Land since 1789. It is the world’s longest surviving written charter of government based on Common Law.
